Children’s Privacy Policy

Fluid Mechanics, Inc. (“Fluid Mechanics,” “we," “us” or “our”) is committed to protecting the privacy of children who may use our website, located at fluidmechanics.net, as well as any other online applications and services, including emails and social media pages, that are operated and controlled by us from which you are accessing this Children’s Privacy Policy (collectively, the “Website”). This Children’s Privacy Policy contains important information for parents on our information collection, disclosure, and parental rights with respect to personal information provided by children under the age of 13 (“Children” or “Child”) through the Website that enables their identification (“Personal Data”).

  1. Personal Data We Collect from Children
    1. We may collect the following types of Personal Data from Children through the Website when a Child registers to maintain an account with us, places an order for services through the Website, signs up to receive emails/newsletters from us, posts a comment on our social media pages or contacts us: name, high school graduation date, email address, postal address, telephone number, username and password, the content of a comment posted on our social media pages.
    2. When Children use the Website, we may automatically collect information about the Child’s use of the Website that does not individually identify the Child but identifies the Child’s computer or device (“Traffic Data”). Such information may include IP address, the hostname of the Child’s computer, geolocation, browser information and reference site domain name every time the Child visits the Website. We may also collect information regarding customer traffic patterns and site usage. We may also receive similar data from our business partners, including online advertising networks, and from social media platforms, such as Facebook, Twitter, YouTube, Pinterest, and Instagram, subject to the Child’s registration and privacy settings with such third-party social media platforms. We use Traffic Data to analyze and improve the Website and to provide our users with a fulfilling Internet experience. Traffic Data is collected using technologies described in the “Passive Information Collection, Use, and Choices” Section of our Privacy and Cookie Notice.
    3. Where permitted by applicable law, we may combine a Child’s Personal Data with other information we have collected from the Child, whether on- or offline, including, for example, Traffic Data.  We may also combine a Child’s Personal Data with information we receive about the Child from other sources, such as our affiliates, publicly available information sources, and third parties.  We treat the combined information as Personal Data.
  2. How We Use Children’s Personal Data
    1. We use a Child’s Personal Data to:
      1. Ensure that content from the Website is presented in the most effective manner for the Child and for the Child’s computer.
      2. Provide the Child with information, products or services that the Child requests from us or that we feel may interest the Child.
      3. Personalize our advertising, marketing communications, shopping experiences, and promotional offers and to deliver promotions and offers to the Child that we think may interest the Child.
      4. Allow the Child to participate in interactive features of our Website, when the Child chooses to do so.
      5. Notify the Child about changes to our Website, products and services.
      6. Create and manage the Child’s personal account with us.
      7. Allow the Child to participate in sweepstakes, contests, and similar promotions, and to administer these activities.  Some of these activities have additional rules, which could contain additional information about how we use and disclose the Personal Data, and we will require parental consent prior to a Child’s submission to participate in such sweepstakes, contests and promotions.
      8. Prevent misuse or improper use of the Website.
      9. Communicate with the Child, including and respond to inquiries.
      10. If the Child signs up for our email list or to receive promotional text messages with parental consent, to send the Child emails about services, offers, or events that we think might be of interest to the Child. By the Child providing the Child’s phone number and clicking submit online, the Child authorizes us to make or initiate text messages to that phone number using an automated system. This agreement is not a condition of purchasing any products or services and the Child may elect to opt-out of receiving such messages by following the unsubscribe instructions provided in any such messages.       11. To send surveys regarding satisfaction with our services, products and overall experience in connection with Fluid Mechanics.
      12. For our business purposes, such as data analysis, audits, developing new services and features, enhancing our website, improving our products and services, identifying Website usage trends, and determining the effectiveness of our promotional campaigns.  
      13. As we believe to be necessary or appropriate: (a) under applicable law, including laws outside your country of residence; (b) to comply with legal process; (c) to respond to requests from public and government authorities, including public and government authorities outside your country of residence; (d) to enforce our terms and conditions; (e) to protect our operations or those of any of our affiliates; (f) to protect our rights, privacy, safety or property, and/or that of our affiliates, you, or others; and (g) to allow us to pursue available remedies or limit the damages that we may sustain.
      14. for any other purpose specified at the point of collection, in which we will require parental consent.
    1. We may use non-personal, non-individual statistics or demographic information in aggregate form without restriction, and we may share such information with our marketing partners, advertisers or other third-parties for analytics purposes.  
  3. How We Share Children’s Personal Data
    1. We will not share the Personal Data we collect from Children other than to third parties:
      1. Who are service providers that perform functions on our behalf. Examples include providing customer service, sending postal mail and e-mail, analyzing data, and providing marketing assistance.
      2. In the event of any reorganization, merger, sale, joint venture, assignment, transfer, or other disposition of all or any portion of our business, assets, or stock (including in connection with any bankruptcy or similar proceeding).
      3. If we are under a duty to disclose or share your Personal Data in order to comply with any legal obligation or to respond to legal process such as a subpoena, warrant, or court order; in order to enforce or apply our terms of use and other agreements or to protect the rights, property, or safety of Fluid Mechanics or any affiliate, our customers, or others.
    1. If a Child chooses to post a comment on any of our social media pages, please note that any information posted will be visible to any other visitors to that social media page.  We are not responsible for any Personal Data the Child includes in such posts or for any use of such information by any other visitor to the social media page.
  4. Parents’ Rights to Review, Delete and Control Our Use of a Child’s Personal Data
    1. Parents have the right to review the Personal Data that we have collected about their children, to delete, and to tell us to no longer use such Personal Data. Parents should contact us at swim@fluidmechanics.net to request access to their Child’s Personal Data or request deletion of their Child’s account from the Website. Note that, where permitted under applicable law, Personal Data may continue to be stored and used if required by law or legal process or to defend ourselves.
  5. Changes to this Children’s Privacy Policy
    1. We may change this Children’s Privacy Policy from time to time. When we do, we will let you know by posting the changed Children’s Privacy Policy on the Website with a new “Last Updated” date. In some cases, we may also tell parents about changes by additional means, such as by sending an e-mail to the e-mail address we have on file for such parents.
